Update: Florida Couple Injured by Texting Driver Settles Personal Injury Lawsuit

Sarasota accident attorneyThe Florida couple severely injured in a New Jersey texting and driving accident has reportedly settled their personal injury lawsuit. David and Linda Kubert both suffered severe injuries when a teen driver swerved onto the wrong side of the road and struck the couple on their motorcycle. Kyle Best later admitted he had glanced at his cell phone just before the accident.

As we previously discussed on this Florida personal injury blog, the case made national headlines after the plaintiffs sought to also hold the sender of a text liable for a distracted driving accident. The lawsuit claims that Shannon Colonna aided and abetted Best’s negligence by texting him when she knew or should have known he was driving.

A New Jersey judge ultimately dismissed the claims against Colonna, declining to extend liability to the sender of a text message. The court reasoned that text message senders can reasonably assume that recipients will act responsibly, and that texters have no ability to control when and where a recipient will read the message. While the Kuberts have settled with Best, they still plan to appeal that ruling.
