Update: Family of Trayvon Martin Seeking Damages from Homeowner’s Association

Fort Myers accident lawyerAs many had predicted, the family of Trayvon Martin is seeking monetary compensation from the homeowner’s association after the community’s neighborhood watch captain George Zimmerman shot their son. Martin’s mother is seeking damages of at least $75,000, according to court documents.

Trayvon’s mother, Sybrina Fulton, is currently fighting a legal battle with the HOA’s insurance company over whether her son’s death falls under the policy. NBC News reports that Travelers Casualty and Surety Company of America has filed court documents seeking clarification of its responsibilities regarding Martin’s death and arguing that it should be resolved of liability.

Travelers states that it "is in doubt of its rights" under the policy and "seeks a declaration of its rights and obligations with respect to the claim" made by Fulton.  It specifically cites a clause in the policy excluding losses caused by or resulting in bodily injury.

Martin’s family is reportedly also looking into other claims under separate insurance policies that may be applicable. Fulton has also filed a claim with the Florida Bureau of Victim Compensation for emergency crime-victim assistance.
