Florida pedestrian accident attorneyAn elderly Florida man in a wheel chair was recently struck and killed by a vehicle while attempting to cross a busy North Fort Myers’ intersection, reports.

A car driven by Jose Manuel Acosta, 38, of Fort Myers, struck and killed Charles Albert Warber from North Fort Myers, Florida Highway Patrol reports show.

Acosta was driving a 1991 Honda sedan eastbound in the outside lane on Hancock while approaching the intersection of Orange Grove Boulevard. Warber, in a wheelchair on the southeast corner of the intersection, entered the crosswalk northbound directly into the path of the car, according to the Florida Highway Patrol.

In this case, it appears that the driver was not at fault. Acosta had a steady green light as he approached the intersection, while the crosswalk for Hancock Bridge Parkway displayed a steady red light.

This tragic accident reinforces the importance of pedestrian safety, particularly when crossing busy intersections. Although the number of accidents has been declining in recent years, Florida still has one of the highest rates of fatal pedestrian accidents in the country.
