Lawsuit Filed in Connection With Jenni Rivera Crash

Fort Myers accident lawyerAs we previously discussed on this Florida Injury Blog, the tragic crash that killed music star Jenni Rivera has once again put charter plane safety concerns front and center. Not surprisingly, the families of several others killed in the crash have filed a negligence lawsuit.

The suit, filed in California, alleges negligence on the part of the previous and current owners of the plane as well as Jenni Rivera’s company, which chartered the flight. They were filed on behalf of the estates of publicist Arturo Rivera, makeup artist Jacobo Yebale, attorney Mario Macias and hairstylist Jorge "Gigi" Sanchez.

As detailed by the New York Daily News, the lawsuit cites a number of factors that could have contributed to the accident, including the age and condition of the aircraft. The lawsuit maintains that the plane was in “defective condition” at the time of the crash and often referred to as a “bucket of bolts.” According to the National Transportation Safety Board, aircraft also suffered significant damage in a 2005 crash in Texas, which was caused by improper fuel balancing.

The negligence lawsuit also questions whether the pilots were trained to safely fly the plane. The complaint alleges that 78-year-old lead pilot Miguel Soto lacked the certifications needed to carry paying passengers or fly in regulated airspace above 18,000 feet. Meanwhile, co-pilot, 20-year-old Alejandro Torres, did not hold the pilot rating required to fly the Learjet model.
