FHP Cracking Down on Florida Hit-and-Run Accidents

Naples personal injury attorneyFollowing an increase in fatal hit-and-run accidents over the last two years, the Florida Highway Patrol is launching a campaign to combat the problem. The campaign aims to reduce the number of hit-and-run accidents by increasing awareness of drivers’ responsibilities if involved in a crash and the consequences for leaving the scene of an accident.

As Cape Coral accident attorneys, we are concerned that hit-an-run crashes are becoming a serious problem in Florida. There were nearly 70,000 Florida hit-and-run crashes in 2012. Moreover, three out of every five fatalities were pedestrians.

With this in mind, we would like to remind drivers about Florida laws regarding leaving the scene of an accident:

  • The driver must immediately stop and remain at the scene, must exchange information and render reasonable assistance to any injured persons.
  • Leaving the scene of a crash involving a death commits a felony of the first degree and carries a maximum penalty of 30 years in a state correctional facility and/or a fine of up to $10,000.
  • Leaving the scene of a crash involving injuries commits a felony of the third degree and carries a maximum penalty of five years in a state correctional facility and/or a fine up to $5,000.
  • Leaving the scene involving property damage commits a misdemeanor of the second degree and carries a maximum penalty of 60 days in a county jail and/or fine of $500.

Drivers who leave the scene of an accident may also be held liable for any injuries caused. In many cases, accident witnesses and the police will be able to track down the offending driver, and the victim can file a personal injury lawsuit.
