Florida Man Wins Slip and Fall Lawsuit Against Walmart

Fort Myers accident lawyerA St. Lucie man was recently awarded nearly $1.3 million in a Florida slip and fall lawsuit against Walmart. Tom Papakalodoukas suffered serious injuries when he slipped on a sign that fallen off a Gatorade display.

As TC Palm reports, surveillance cameras in the Port St. Lucie store captured video of the Gatorade sign falling. Shortly thereafter, Papakalodoukas is seen slipping on the sign and falling violently to the ground.

Papakalodoukas tore his right bicep when he fell, resulting in a condition called “popeye deformity.” As the name suggests, the injury causes a permanent bulge in the bicep. He has had three surgeries in two years to help restore strength to his arm. In addition to his medical bills, which total almost $200,000, Papakalodoukas also faces a lifetime of lost wages due to the condition, which impacted his dominant arm.

While Walmart tried to shift the blame to Gatorade, the jury ultimately found that Walmart was negligent in putting up the product display. It awarded Papakalodoukas $1,287,144.

The case is one of several successful slip and fall lawsuits against the retail giant in recent years. In 2011, a jury awarded $11 million to a Wyoming truck driver who was injured after slipping on ice and grease at a Colorado Walmart.
