Troubled NFL Star Ordered to Pay $125,000 in Florida Personal Injury Lawsuit

Fort Myers personal injury attorneyNew York Jets wide receiver Plaxico Burress is on the wrong side of the law again. This time he is on the losing side of a Florida personal injury lawsuit resulting from a 2008 car accident.

A Florida jury found Burress liable for the accident, and a judge awarded Alise Smith $125,000 plus interest, according to the New York Daily News. In this case, the plaintiff likely benefited from a rebuttable presumption under Florida law. It presumes that the negligence of the rear driver in a rear-end collision was the sole proximate cause of the accident, unless the defendant is able to prove otherwise.

According to reports, the accident occurred near a Florida Turnpike toll plaza in Tamarac. Burress was behind the wheel of his Mercedes-Benz when he rear-ended Smith’s 1997 Ford Probe. He was also driving without insurance, as the insurance on Burress’ car had been terminated three days before the accident.

Following the accident, Smith, then 27, filed suit in Broward County, seeking compensation for injuries she suffered to her back and neck as a result of the crash As is common in many Florida personal injury cases, she sued Burress for damages, medical bills, and lost wages.
